Terms of Service

These Terms of Service (“Terms”) govern your access to and use of KASII, a case management agent service operated by PageHub (“KASII,” “we,” “us”). By creating an account, sending or receiving messages through KASII, or otherwise using the service, you agree to these Terms.

KASII is offered to law firms (each, a “Firm”) and is used to communicate with their clients (“Clients”). The Firm is responsible for its lawful use of the service and for any content it directs KASII to send.

KASII provides Firms with tools to: schedule and deliver client check-ins via SMS, MMS, and email; collect loss-theory and demographic information; track treatment adherence; and send case updates. The exact features available depend on the plan the Firm has signed up for.

• You must be at least 18 years old and able to form a binding contract.
• You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
• You must provide accurate information and keep it current. We may suspend or terminate accounts that violate these Terms.

By providing a mobile number to a Firm using KASII, a Client consents to receive SMS and/or MMS messages from KASII on that Firm's behalf related to their case. The program operates as follows:

• Program description: case-related check-ins, treatment reminders, demographic confirmations, pain-level updates, and case progress messages from the representing Firm.
• Message frequency:recurring; frequency varies based on the case stage and the Firm's configuration.
• Cost:message and data rates may apply, depending on the Client's mobile carrier plan. KASII does not charge Clients for messages.
• Opt-out: reply STOP to any KASII message to unsubscribe. We will send one final confirmation that no further messages will be sent.
• Help: reply HELP to any KASII message to receive support information, or contact us at support@kasii.pagehub.dev.
• Carriers: supported on major US carriers. Carriers are not liable for delayed or undelivered messages.
• No marketing sharing: mobile numbers, opt-in data, and messaging content are never shared with third parties or affiliates for marketing or promotional purposes. See our Privacy Policy.

You agree not to use KASII to:

• Send unsolicited marketing, spam, or messages prohibited by law.
• Send harassing, abusive, defamatory, fraudulent, or otherwise unlawful content.
• Send messages of types disallowed by the carriers or messaging providers (including content related to sex, hate, alcohol, firearms, or tobacco outside permitted use cases; high-risk financial services; or anything violating the CTIA Messaging Principles and Best Practices).
• Impersonate any person or entity, or misrepresent your affiliation with a Firm or Client.
• Attempt to disrupt, reverse-engineer, scrape, or gain unauthorized access to the service.
• Use the service in violation of applicable law (including TCPA, CAN-SPAM, and state privacy laws) or any contractual or ethical duty (including attorney professional-conduct rules).

• The Firm is responsible for obtaining and documenting Client consent before adding any Client to a KASII messaging program.
• The Firm warrants it has the legal right to share Client information with KASII for the purposes of operating the service.
• The Firm is solely responsible for the legal and ethical content of any communications it directs KASII to send.

Paid plans are billed in advance on the cadence selected at signup. Fees are non-refundable except where required by law. We may change pricing on renewal with prior notice through the dashboard or email.

KASII and its underlying software, design, and content are owned by PageHub and its licensors and are protected by intellectual-property laws. We grant you a limited, revocable, non-transferable license to use the service consistent with these Terms. You retain ownership of the content you submit; you grant us the rights necessary to operate the service on your behalf.

Each party will protect the other's confidential information using reasonable care and only use it to perform under these Terms. Client information that a Firm uploads is treated as the Firm's confidential information.

KASII is provided “as is” and “as available.” We disclaim all warranties to the fullest extent permitted by law, including warranties of merchantability, fitness for a particular purpose, and non-infringement. KASII does not provide legal advice and is not a substitute for an attorney's professional judgment.

To the fullest extent permitted by law, KASII and PageHub will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly. Our aggregate liability for any claim arising out of or relating to the service will not exceed the amounts paid by you to us in the twelve months preceding the event giving rise to the claim.

You agree to indemnify and hold harmless KASII and PageHub from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the service, your content, or your breach of these Terms.

You may stop using KASII at any time. We may suspend or terminate your access if you violate these Terms or if continuing the service would expose us to legal or carrier risk. Upon termination, the rights granted to you cease and we may delete account data after a reasonable retention period.

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules. The exclusive venue for disputes is the state and federal courts located in Delaware, and the parties consent to personal jurisdiction there.

We may modify these Terms from time to time. Material changes will be announced through the dashboard or email. Continued use of KASII after the effective date constitutes acceptance.
